- 什么是回美證?
回美證是移民局簽發給出国一年以上的綠卡或臨時綠卡持有者的,方便他們出國以及回美。出國一年以上適用于綠卡或臨時綠卡持有者要在國外生活一年以上必須申請回美證,否則綠卡可能被取消。如果在國外生活6個月以上一年以內,我們建議也應該辦理回美證,避免遭到海關的為難。
以下情況移民局不會批準回美證:
- 申請人已有回美證并且目前仍有效,除非之前的文件被遞交回移民局或者申請者能夠證明文件已丟失
- 申請人去的地方是移民局已經公布的不予簽發回美證的地區
2. 有效期:
對于綠卡持有者,一般每一次簽發從簽發日算起有效期者是2年;如果自拿到綠卡起前5年的4年以上都在美國以外居住,則有效期只有1年,以下情況除外:
- 申請人是在執行美國政府除驅逐,調動以外的命令
- 在某國家的國際組織工作,且該國已與美國建立條約
- 需在美國以及全世界各地進行比賽的專業運動員
- 對于臨時綠卡,有效期自簽發日算起,到期日是2年以后或者臨時綠卡到期時,以兩者較近的時間為準
注意:歸化入籍對連續居住時間有要求,連續在國外居住6個月以上時間可能會造成影響。如果想申請入籍者預備在國外居住1年以上,為了保證不影響入籍資格,申請人需另外提交N-470表格。
3. 申請流程:
提交I-131表格及相關文件
按要求去指定地點進行生物技術識別(缺席會導致申請被拒)
4. 申請時間:
從遞交材料到批準需要3-4個月,以下情況可以申請加急處理:
- 公司或個人造成嚴重經濟損失
- 極度緊急情況
- 出于人道主義考慮
- 非盈利機構出于國防部或國家利益考慮提出的申請(要求申請者必須來自美國國家機關或州政府機關,并且說明延期會造成危害)
申請加急應用黑色筆在信封右上角標注”EXPEDITE”,即加急字樣,內附加急的文字說明及相關證明文件
5. 政府費用:
提交I-131表 $360 (14歲至79歲申請人)
生物技術識別 $85 (14歲至79歲申請人)
1, Applicant:
- lawful permanent resident or conditional permanent resident (lawful permanent resident based on marriage or a qualifying investment)
- staying outside of United States for longer than 1 year (custom probably will ask even if you return after 6 months but within 1 year)
2, A Reentry Permit may not be issued to you if:
(1) You have already been issued such a document, and it is still valid, unless the prior document has been returned to USCIS or you can demonstrate that it was lost; or
(2) A notice was published in the Federal Register that precludes the issuance of such a document for travel to the area where you intend to go.
3, Timing issue: (A Reentry Permit may not be extended.)
To lawful permanent:
- Valid general 2 years from the date of issuance (8 CFR section 223.3(a)(1))
- Valid 1 year if have been outside the United States for more than 4 of the last 5 years since becoming a lawful permanent resident except:
- On the order of the U.S Government other than other than an exclusion, deportation, removal, or rescission order
- Employed by a public international organization of which the United States is a member by treaty or statute;
- Professional athlete and regularly competes in the United States and worldwide.
To conditional permanent resident:
- Valid 2 years from the date of issuance, or to the date the conditional permanent resident must apply for removal of the conditions on his or her status, whichever date comes first.
Note:
Absences from the United States of six months or more may disrupt the continuous residency required for naturalization. If your absence is one year or longer and you wish to preserve your continuous residency in the United States for naturalization purposes, you may file an Application to Preserve Residence for Naturalization Purposes on Form N-470.
4, Process:
1). File form I-131, submit:
- A copy of the front and back of your Form I-551; or
- If you have not yet received your Form I-551, a copy of the biographic pages of your passport and a copy of the visa page showing your initial admission as a lawful permanent resident, or other evidence that you are a lawful permanent resident; or
- A copy of the Form I-797
2). Complete the biometrics services at a local ASC under instruction of USCIS after filing I-131.
5, Processing time
Generally 3-4 month.
Expedited processing is available (type or print the word EXPEDITE in the top right corner of the application in black ink) if applicant Include a written explanation of the reason for the request to expedite with any supporting evidence available. The burden is on the applicant to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:
- Severe financial loss to company or individual;
- Extreme emergent situation;
- Humanitarian situation; or
- Non-profit status of requesting organization in furtherance of the cultural and social interests of the United States Department of Defense or National Interest Situation. (Note: The request must come from an official United States Government entity and state that a delay will be detrimental to the U.S. Government.)
- Filing fee:
$360 for Reentry Permit (for applicants ages between 14-79)
$85 for biometrics services (for applicants ages between 14-79)
